1. Agreement to these terms

These Terms of Use (“Terms”) are a legal agreement between you and Adventure Therapy Foundation, Inc., a California nonprofit corporation (“Adventure Therapy Foundation,” “ATF,” “we,” “us,” or “our”). They govern your use of adventurefound.org (the “Site”) and of our programs, applications, forms, content, events, and communications (together with the Site, the “Services”).

By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

Our Privacy Policy and, where applicable, our Consumer Health Data Privacy Notice are incorporated into these Terms by reference.

2. Important: our programs are not medical or mental health care

Adventure Therapy Foundation does not provide medical advice, diagnosis, or treatment, and does not provide psychotherapy, counseling, or mental health treatment.

Please read this section carefully.

  • Our programs — including Kinship peer support groups, RISE coaching, retreats, events, our blog, podcast, book, and other content — offer peer support, community, education, and coaching. They are not a substitute for professional medical, psychological, psychiatric, or other health care.
  • Using the Services, applying to a program, participating in a group, or communicating with our staff, facilitators, coaches, or volunteers does not create a doctor-patient, therapist-client, or other professional treatment relationship.
  • Our facilitators, coaches, and volunteers are not acting as your licensed health care providers, even if some of them hold professional licenses in another context.
  • Always seek the advice of your physician or another qualified health provider with any questions you have about a medical or mental health condition. Never disregard professional medical advice, or delay seeking it, because of something you read, heard, or discussed through our Services.
  • Content on the Site, in our newsletter, podcast, book, and RISE modules is for general informational and educational purposes only. We do not guarantee that it is accurate, complete, or applicable to your situation.

If you are experiencing a medical emergency, call 911. If you are in emotional distress or thinking about harming yourself, call or text 988 (the Suicide and Crisis Lifeline) or go to your nearest emergency room. Do not use the Services to seek emergency help — we do not monitor communications in real time and cannot respond to emergencies.

3. Who may use the Services

You must be at least 18 years old to use the Services, submit a form, apply to a program, or make a donation. The Services are not directed to children. By using the Services, you represent that you are 18 or older and that the information you give us is accurate and complete.

4. Applications, program participation, and community expectations

Applying is not acceptance. Submitting an Application for Services or registering interest does not guarantee placement. Our programs have limited capacity, and placement depends on fit, group composition, timing, and available resources. We decide whom to admit in our sole discretion, and we are not obligated to explain a decision.

Voluntary information. Some questions on our forms — including “How has cancer intersected with your life?” — are optional. You may skip them or share only what you are comfortable sharing. How we handle what you share is described in our Privacy Policy.

Community expectations. If you participate in a group, retreat, or coaching program, you agree to:

  • Treat other participants, facilitators, and staff with respect
  • Keep confidential what other participants share, and not record, transcribe, photograph, screenshot, or repost group sessions or another participant’s story without their permission
  • Refrain from giving other participants medical advice, and from promoting products, services, treatments, or fundraising campaigns
  • Follow the specific guidelines for the program, retreat, or event you are attending

Confidentiality has limits. We ask every participant to hold what is shared in confidence, and we hold ourselves to that as well. But we cannot guarantee that other participants will honor it, and you should share only what you are comfortable having others hear. We may also disclose information where we believe in good faith that someone is at risk of serious harm, or where the law requires it.

We may end participation. We may suspend or remove any participant, at any time and in our sole discretion, including for conduct that is harmful, disruptive, or inconsistent with these Terms or a program’s guidelines.

5. Events, retreats, and in-person activities

Events, retreats, and outdoor or adventure-based activities involve inherent risks, including risk of physical injury and, in some settings, serious injury or death. Participation is voluntary. Registration for these activities is subject to additional terms, waivers, releases, assumption-of-risk agreements, medical forms, and cancellation policies, which we will provide at registration and which you must sign before participating. Where those documents conflict with these Terms, those documents control for that event.

You are responsible for determining, with your health care providers, whether you are physically and medically able to participate in a given activity.

6. Donations

  • Donations are voluntary and non-refundable, except where a gift was made in error or processed incorrectly. If you believe there is an error, contact us at [CONTACT EMAIL] within 30 days and we will work with you in good faith.
  • Recurring gifts continue on the schedule you select until you cancel. You may cancel at any time by contacting us at info@adventurefound.org or through your donation account; please allow up to 15 business days for the change to take effect.
  • Adventure Therapy Foundation is a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code, EIN 61-1896557. Donations are tax-deductible to the extent allowed by law. No goods or services are provided in exchange for a donation unless we tell you otherwise in writing. We will send an acknowledgment for gifts as required by law. We do not provide tax advice; please consult your own advisor.
  • Use of funds. We honor donor designations where we can, but we reserve the right to apply gifts where the need is greatest, consistent with our mission and with applicable law, including when a designated program is fully funded or discontinued.
  • Donations are processed by Harness Giving, a third-party donation platform and payment provider. Your use of that platform is also subject to its own terms and privacy policy.

7. Email and text messages

By giving us your email address, you agree that we may email you about the programs, events, and updates you signed up for, and about any program you are enrolled in. You can unsubscribe from marketing emails at any time using the link in any message.

[If you give us your mobile number and agree to receive text messages, you consent to receive program, event, and reminder texts from us at that number, including messages sent using an automated system. Consent to receive texts is not a condition of participating in any program or of making a donation. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help. We do not include health-related details in text messages.]

8. Online store

Merchandise offered through our online store is produced, sold, and fulfilled by a third-party provider. Orders, payment, shipping, returns, and customer service for those items are handled by that provider under its own terms and privacy policy. Adventure Therapy Foundation is not responsible for those transactions.

9. Content you submit

You keep ownership of the content you submit to us — messages, survey responses, testimonials, photographs, stories, and other materials (“Your Content”). By submitting Your Content, you grant us a non-exclusive, royalty-free, worldwide license to store and use it for the purpose you submitted it for (for example, to review your application or respond to your message).

We will not publish, quote, or use Your Content in marketing, fundraising, or publicity without your separate written permission. If you give that permission, you grant us a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, adapt, and display the material you approved, in the ways described when you gave permission. You may withdraw that permission for future use at any time by contacting us; we will stop using it going forward but cannot always recall materials already printed or distributed.

You represent that you have the right to submit Your Content and that it does not infringe anyone’s rights or violate any law. Please do not send us confidential business information or unsolicited ideas — we have no obligation to keep unsolicited submissions confidential. We may remove or decline any content for any reason.

10. Acceptable use

You agree not to:

  • Use the Services for any unlawful purpose, or in violation of these Terms
  • Harass, threaten, defame, impersonate, or discriminate against anyone
  • Post or transmit content that is unlawful, abusive, obscene, or infringing
  • Record, publish, or redistribute another participant’s story or personal information without permission
  • Solicit participants for commercial purposes, promote treatments or products, or use the Services to advertise
  • Attempt to gain unauthorized access to the Site, our systems, or another user’s account
  • Introduce malware, or interfere with or disrupt the Services
  • Scrape, crawl, harvest, or use automated means to collect content or data from the Site, or use our content to train machine learning or artificial intelligence models, without our prior written permission
  • Misrepresent your identity, eligibility, or affiliation

11. Intellectual property

The Site and its contents — including text, graphics, logos, photographs, videos, podcast episodes, blog posts, curriculum, RISE modules, book content, and the selection and arrangement of all of it — are owned by Adventure Therapy Foundation or its licensors and are protected by copyright, trademark, and other laws. “Adventure Therapy Foundation,” “Kinship,” “RISE,” “Adventures with Scars,” “Cancering Collective,” and our logos are our marks.

We grant you a limited, revocable, non-transferable license to access and use the Site and its content for your personal, non-commercial use. You may share links to our content, and you may reproduce short excerpts with attribution. Any other use — including reproduction, distribution, adaptation, or commercial use — requires our prior written permission.

If you believe content on the Site infringes your copyright, contact us at info@adventurefound.org with a description of the work, the location of the material, your contact information, and a statement of good-faith belief that the use is unauthorized.

12. Third-party services and links

The Services link to and rely on third-party websites and platforms, including our donation platform, online store, email provider, virtual meeting platform, podcast hosts, and social media pages. We do not control them and are not responsible for their content, practices, availability, or terms. Links are not endorsements. Your use of a third-party service is governed by that service’s terms and privacy policy.

13. Privacy

Our collection and use of information is described in our Privacy Policy. Please read it. Section 2 of the Privacy Policy explains that we are not a HIPAA covered entity and that information you share with us is not protected health information under HIPAA.

14. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, Adventure Therapy Foundation disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Services or any server we use are free of harmful components. We do not warrant that participation in any program will produce any particular outcome, benefit, or result, and we make no representation about the qualifications of any participant, volunteer, or contractor beyond our own screening practices.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

15. Limitation of liability

To the fullest extent permitted by law, Adventure Therapy Foundation and its officers, directors, employees, contractors, facilitators, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or emotional distress, arising out of or relating to your use of the Services — whether based in contract, tort, negligence, strict liability, or any other theory, and even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for all claims relating to the Services will not exceed the greater of (a) the amount you paid us, if any, in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for gross negligence, willful misconduct, or personal injury caused by our negligence where applicable law does not permit exclusion. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

16. Indemnification

You agree to indemnify, defend, and hold harmless Adventure Therapy Foundation and its officers, directors, employees, contractors, facilitators, volunteers, and agents from any claims, liabilities, damages, losses, and expenses — including reasonable attorneys’ fees — arising out of or related to your use of the Services, your violation of these Terms, your violation of any law or third-party right, or content you submit.

17. Suspension and termination

We may modify, suspend, or discontinue any part of the Services, and may suspend or terminate your access or program participation, at any time and for any reason, with or without notice. Sections that by their nature should survive termination — including Sections 9, 11, 14, 15, 16, 18, and 19 — will survive.

18. Governing law and venue

These Terms and any dispute arising out of them or the Services are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and Adventure Therapy Foundation agree that the exclusive venue for any dispute will be the state or federal courts located in Contra Costa County, California, and you consent to personal jurisdiction there.

19. Resolving disputes

Before filing any claim, you agree to first contact us at info@adventurefound.org with a written description of the dispute and to spend 30 days trying in good faith to resolve it informally. Most concerns can be worked out this way, and we would much rather talk with you.

20. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date above. If a change is material, we will provide notice on the Site or by email before it takes effect. Your continued use of the Services after a change takes effect means you accept the revised Terms.

21. General

  • If any provision of these Terms is held unenforceable, the rest remain in effect and the unenforceable provision will be modified to the minimum extent necessary.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • You may not assign these Terms. We may assign them to a successor organization.
  • Entire agreement. These Terms, the Privacy Policy, the Consumer Health Data Privacy Notice, and any program-specific agreements are the entire agreement between you and us regarding the Services.
  • No third-party beneficiaries. These Terms do not create rights for anyone other than you and us.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
  • We may give notice by email to the address you provided or by posting on the Site. You may give notice to us at the address below.
